1. Acceptance of These Terms
By using this website (somersetwesttaxitours.online) or booking a vehicle rental, airport transfer, tour, or chauffeur service with Somerset West Taxi Tours & Car Rental (“we”, “us”, “our”), you agree to these Terms & Conditions, our Payment & Cancellation Policy, and our Privacy & POPIA Notice. If you do not agree, please do not use this website or our services.
2. Our Services
We provide self-drive vehicle rental, chauffeur-driven airport transfers, Cape Winelands and Peninsula tours, and related transport services (including for weddings, corporate travel, and real estate client transport) in and around Somerset West, the Cape Winelands, and greater Cape Town.
3. Bookings, Deposits & Cancellations
All bookings are subject to our Payment & Cancellation Policy, which forms part of these Terms and covers our securing deposit, balance payment schedule, refundable security deposit, and cancellation terms. Please read it before booking.
4. Vehicle Rental Eligibility
To rent a self-drive vehicle you must hold a valid South African driver’s licence or International Driving Permit (IDP), and provide valid ID or passport and proof of address, as set out on our FAQ page. We reserve the right to decline a rental where these requirements are not met, or where we reasonably believe a renter poses a safety or fraud risk.
5. Included Mileage & Excess Charges
Rentals include a daily kilometre allowance as displayed on the relevant vehicle listing at time of booking. Kilometres travelled beyond this allowance are charged at the rate shown at booking. Current allowances and rates are published on our Fleet & Rates page and may be updated from time to time; the rate applicable to your booking is the one confirmed at the time you book.
6. Pricing
All prices are quoted in South African Rand (ZAR) and are correct at the time of publication but may change without notice. The price confirmed to you at the time of booking is the price that applies to that booking.
7. Payment
Payments are processed securely through iKhokha, an independent, registered South African payment service provider. We do not receive or store your full card details. By making a payment through this website you also agree to iKhokha’s own terms of service as presented to you at checkout.
8. Vehicle Condition, Insurance & Liability
Vehicles are provided in a roadworthy condition and are subject to the insurance cover, excess amounts, and driver liability terms communicated to you at the time of booking or vehicle handover. You are responsible for the vehicle for the duration of the rental period, including any traffic fines or e-toll charges incurred, and for returning it in the condition it was received, fair wear and tear excepted.
9. Chauffeur & Tour Services
For chauffeur-driven transfers and tours, our drivers will make reasonable efforts to meet agreed pickup times, but are not liable for delays caused by traffic, weather, flight delays, or other circumstances outside our reasonable control. Tour itineraries are indicative and may be adjusted for safety, weather, or operational reasons.
10. Use of This Website
You agree to use this website only for lawful purposes and not to attempt to interfere with its security, submit false booking or identity information, or use automated tools to scrape or overload the site. All content on this website (text, images, branding) remains the property of Somerset West Taxi Tours & Car Rental or its licensors and may not be reused without our written permission.
11. Your Rights Under the Consumer Protection Act
Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded. Where any term of these Terms conflicts with a right you hold under that Act, your statutory right takes precedence.
12. Limitation of Liability
To the fullest extent permitted by South African law, we are not liable for any indirect or consequential loss arising from your use of our services or this website. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for gross negligence or in respect of your rights under the Consumer Protection Act.
13. Governing Law
These Terms are governed by the laws of the Republic of South Africa, and any dispute arising from them will be subject to the jurisdiction of the South African courts.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of this website or our services after an update constitutes acceptance of the revised Terms. The “Last updated” date above reflects the most recent revision.
